This contest is sponsored by The Personal Insurance Company and The Personal General Insurance Inc. (collectively referred to hereinafter as "The Personal"). The contest runs from February 15, 2011 to December 31, 2011, at 11:59 p.m. (Eastern Standard Time).
The contest is open exclusively to CANEX authorized patrons eligible for insurance under the CANEX group insurance plan.
One chance to win per person per insurance product.
Employees, representatives, and agents of The Personal or any other Desjardins General Insurance Group Inc. entity, and anyone with whom the above mentioned reside, may not enter the contest.
The winners will be selected by means of twenty-six (26) electronic draws held at 3 p.m. at The Personal's office at 3 Robert Speck Parkway, Mississauga, Ontario, L4Z 3Z9, on the following dates:
Twenty-five (25) draws for the secondary prizes valued at $250 CDN each, from among all eligible contest entries on the following dates:
March 15, 2011 : four (4) draws;
April 15, 2011 : three (3) draws;
May 16, 2011 : two (2) draws;
June 15, 2011 : two (2) draws;
July 15, 2011 : three (3) draws;
August 15, 2011 : two (2) draws;
September 15, 2011 : two (2) draws;
October 17, 2011 : three (3) draws;
November 15, 2011 : two (2) draws;
and December 15, 2011 : two (2) draws.
One (1) grand prize draw on January 19, 2012, to be chosen from all twenty-five (25) winners of secondary prizes in the preceding draws.
The odds of winning depend on the number of quote requests received and the number of clients in the database.
No entrant may win more than one secondary prize. However, all winners of secondary prizes are eligible for the grand prize draw and will be among the twenty-five (25) finalists.
The contest entrant is the person whose name appears on the insurance policy or quote. In the event that two individuals are joint insurance policyholders or jointly request an insurance quote, the person who is a CANEX authorized patrons will be the one who must answer the mathematical skill–testing question and will receive the prize in his/her name. If both individuals are CANEX authorized patrons, either may answer the mathematical skill–testing question, but the prize will be awarded in the names of both individuals.
Secondary Prizes
To obtain a secondary prize, each winner must meet the eligibility criteria mentioned herein and:
Be reached by telephone within ten (10) business days of the draw;
Correctly answer a time-limited, mathematical skill–testing question asked over the telephone;
Consent to the use of his/her name, place of residence, photograph, or voice in any contest-related advertising, without any compensation whatsoever (in particular, the winners' names will be posted online starting March 30, 2011, at www.canex.thepersonal.com ); and
Sign a declaration and release form according to the terms provided for by The Personal, if required by The Personal, and return it within ten (10) days of its receipt.
Failing this, The Personal will select another winner. This subsequent draw will proceed in the same manner as described herein, with the exception of the date, which cannot be the same.
The prizes will be mailed to the winners within four (4) weeks of the respective draw date. The Personal disclaims any and all responsibility in the event of loss or theft of the CANEX gift cards.
Grand Prize
To obtain the grand prize, the winner must fulfill the same requirements as outlined in article 5, except for paragraph b).
Within ten (10) business days of reaching the winner by phone, The Personal will mail a letter to the winner describing the procedure to claim the prize. In the event that the winner fails to meet the various conditions, The Personal will be released from any and all obligations regarding the awarding of the prize and may hold a new draw in the same manner as described in these rules, with the exception of the date, which cannot be the same. At its sole discretion, The Personal may also choose to cancel the prize.
The winner acknowledges that starting from the date on which The Personal confirms the date on which he/she can take possession of his/her prize, the delivery of services related to the prize becomes the entire and exclusive responsibility of the various manufacturers/dealers.
The grand prize cannot be transferred to another person or to the winner's successors or heirs.
The winner may waive his/her right to receive the grand prize and choose instead to receive a cheque for fifty thousand Canadian dollars ($50,000 CDN).
Within ten (10) days of receiving the letter by mail informing him/her of how to take possession of the prize, the winner must make his/her choice known to The Personal. Once The Personal has received confirmation of this choice in writing, no modification will be accepted and a cheque will be issued to the winner as soon as possible.
In the event that The Personal cannot award the prize as described herein, it reserves the right to award a similar prize of equal value or, at its discretion, the value of the prize described herein in cash.
The Personal will indicate to the winner the names of the dealers where he/she may claim the vehicles. The Personal will undertake any and all negotiations with the selected dealers, regardless of the type of prize selected by the winner.
Subject to availability, the winner may select the interior and exterior colors of the vehicles offered as prizes, optional equipment and accessories available, and optional extended vehicle warranties. If a vehicle selected by the winner is not available for any reason whatsoever, the winner must choose another vehicle from among the eligible models according to the terms and conditions herein. In all cases the total value of the prize may not exceed $50,000 CDN (applicable taxes and delivery are included in this amount and no additional amount will be awarded).
The total price of the vehicles must include, but is not limited to, sales taxes, transportation and preparation fees, tire tax, and, as applicable, excise tax on the air conditioner, additional exterior painting fees, accessory installation fees, any extended protection program for vehicles offered as prizes, as well as any other required fees. If the total price of the vehicles is less than $50,000 CDN, no cash refund will be awarded for the difference. If the total price of the vehicles exceeds $50,000 CDN, the winner must assume the balance in full.
Contracts will be issued in the winner's name and The Personal will undertake all negotiations with the dealers it selects and will pay the invoices. Once the invoices have been paid, The Personal assumes no liability in connection with the products.
The winner is responsible for any fees not included in the abovementioned prize description, including but not limited to vehicle registration, insurance, driver's license, owner registration, any other fees associated with the claim, registration, or use of the vehicles offered as prizes, any regular maintenance or repair fees not covered by manufacturers' warranties, and transportation fees to the dealers selected for taking possession of the vehicles.
If none the vehicles selected by the winner nor the winner's replacement choices are available for any reason whatsoever, The Personal will offer the winner a prize of equal value at its sole discretion.
The vehicles will be delivered directly to the dealers selected by The Personal. Once the dealers notify the winner that the vehicles have arrived and are ready to be delivered, the winner must take possession of them within two weeks of said notification, failing which it is agreed that the winner automatically waives his/her right to the prize and will not be awarded any compensation.
To claim his/her prize, the winner must present a piece of identification bearing his/her photograph, hold a valid driver's license, have proof of the appropriate auto insurance, and not have any criminal convictions associated with the use or operation of a motor vehicle for which a pardon has not been granted.
In the event the selected entrant does not comply with one or more of the abovementioned terms or any other term herein or refuses to claim his/her prize, he/she will be disqualified. At the discretion of The Personal, a new draw may be held to award the prize in accordance with these rules until an entrant is selected and declared the winner. The new draw will proceed in the same manner as described herein, with the exception of the date, which cannot be the same. Depending on the circumstances, The Personal also reserves the right to cancel the prize.
The grand prize winner acknowledges that the only warranties applicable to this prize are the warranties normally offered by the manufacturers and that the delivery of services related to the delivery of the vehicles and after-sale customer service is under the entire responsibility of the manufacturers and designated dealers. A statement to this effect will be included in the Declaration and Release Form.
The grand prize winner acknowledges that once he/she has received a letter confirming that he/she has won the prize and explaining how he/she can take possession of it, the delivery of services related to this prize becomes the full and exclusive responsibility of the manufacturer/dealer of each vehicle. A statement to this effect will be included in the Declaration and Release Form.
In the event that it is impossible, difficult, or more expensive for The Personal to award the grand prize as described herein, it reserves the right to award a similar prize of equal value or, at its sole discretion, the value of the prize described herein in cash.
All quote requests are the property of The Personal.
The Personal reserves the right to modify the terms of this contest or cancel it without notice at any time, subject to the approval of Régie des alcools, des courses et des jeux du Québec.
The Personal reserves the right to disqualify any entrant or cancel any entry that does not comply with these rules.
All decisions made by The Personal are final and binding, subject to any decision of Régie des alcools, des courses et des jeux du Québec on any matter under its jurisdiction.
For Quebec residents, disputes regarding the organization or conduct of a promotional contest may be submitted to Régie des alcools, des courses et des jeux du Québec for a ruling. Disputes regarding the awarding of a prize may be submitted to Régie des alcools, des courses et des jeux du Québec, but only for the purpose of helping the parties reach a settlement.
The Personal cannot be held liable for lost, misdirected, or late entries, or for any failure, for any reason whatsoever, that may affect the availability or operation of the website or any telecommunications systems and networks for the duration of this contest. Moreover, The Personal cannot be held liable for any damage to entrants' computers or to components of computer systems used to enter this contest.
By entering this contest, participants release The Personal of all liability for any damage that could result from said entry or from the acceptance or use of the prize if a person is declared the winner.
The winner acknowledges that the only warranty applicable to each prize is the warranty normally offered, where applicable, by the various manufacturers/dealers.
The winner acknowledges that the delivery of services related to each prize is the entire and exclusive responsibility of the various manufacturers/dealers.
The various manufacturers/dealers are not associated with this contest and are not sponsoring it in any way.
