STATUTORY ACCIDENT BENEFITS OPTIONS

Statutory Accident Benefits provide coverage if you're injured in a car accident, regardless of whether you're at fault or not at-fault. Here's a summary of the standard benefits and options available to increase your benefits.

Medical, rehabilitation and attendant care benefits

Medical and rehabilitation benefits cover the cost of reasonable and necessary expenses, such as physiotherapy and prescriptions that are not covered by OHIP (Ontario Health Insurance Plan) or your disability insurance plan.

Attendant care benefit pays for an aide or attendant to look after you if you're seriously injured in an accident.

 

For non-catastrophic injuries

Up to $65,000 for medical, rehabilitation and
attendant care benefits, including assessment
costs, for a duration of 5 years
Options available to increase your benefits
Up to $130,000 for medical, rehabilitation and
attendant care benefits, including assessment costs, for a duration of 5 years
or
Up to $1,000,000 for medical, rehabilitation and
attendant care benefits, including assessment
costs, for a lifetime duration

 

For catastrophic injuries

If you suffer an injury in an accident, you can apply for a determination of whether your injury qualifies as “catastrophic” (e.g., loss of a limb, paraplegia). If the injury qualifies as “catastrophic” you are eligible for an increased level of benefits.

Caregiver benefit

If you're providing full-time care to dependants and can no longer provide that care as the result of a car accident, you may be eligible for caregiver benefits to reimburse you for your expenses to hire someone to care for your dependants.

Up to $250 per week for the first dependant and $50 for each additional dependant. Available only for catastrophic injuries

Up to $250 per week for the first dependant and

Housekeeping and home maintenance expenses

If you can't do housekeeping or home maintenance chores because of your injuries, this benefit pays for reasonable and necessary additional expenses for someone to complete chores you normally do.

Up to $100 per week. Available for all injuries

Income replacement benefit

If you can't work as the result of a car accident, you may be eligible for basic weekly income replacement benefits of up to $400. This benefit starts after one week.

$1,000 per week

Dependant care benefit

If you're employed and are injured in a car accident, dependant care benefit pays for additional expenses to care for your dependants.

Death and funeral benefits

If you die as a result of a car accident, the death benefit provides a lump sum payout to your spouse and dependants. The funeral benefit provides a lump sum payout for funeral expenses.

$10,000 lump sum to each dependant

Maximum $6,000 funeral benefits

Option available to increase your benefits
Lump sum increased to $50,000 to an eligible spouse

Lump sum increased to $20,000 to each dependant

Funeral benefits increased to a maximum of $8,000

Indexation benefit

Indexation is an additional benefit that allows the following benefits to be adjusted for inflation:

  • Medical, rehabilitation and attendant care benefits
  • Caregiver benefit
  • Income replacement benefit
  • Non-earner benefit
